Photo Collection: Statement of Permission
Olathe Public Library Historic Photograph Collection Statement of Permission
This photograph is property of the Olathe Public Library. It may be used for purposes such as criticism, comment, news reporting, teaching, scholarship, private study or personal use, as long as a credit statement is included; however, any other use such as commercial publication or multiple reproductions requires written permission from the Olathe Public Library.
The Olathe Public Library is unaware of any claim of copyright in the images in the collection. We encourage use of these materials under the fair use clause of the Copyright Act (17 U.S.C. § 101 et seq). The Olathe Public Library has provided in the catalog records for these materials all known information regarding the photographer or other persons associated with the materials. This information is provided as a service to aid users in determining the appropriate use of an item, but that determination ultimately rests with the user.
The person(s) whose image(s) appears in a photograph(s) included in this compilation has not agreed to commercial use of his or her name(s) or likeness(es). Such usage may be actionable at law by these persons or their heirs. The Olathe Public Library assumes no liability for misuse of any photograph. As a condition of accessing the website, the user agrees to indemnify and hold the Olathe Public Library harmless for any claimed misuse of the likenesses of persons appearing in the image.
The copyright law of the United States governs the making of photocopies or other reproductions of copyrighted materials. Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specified conditions is that the photocopy or other reproduction is not to be used for any purpose other than private study, scholarship or research. If a user makes a request for, or later uses, a photocopy or other reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement.
The Olathe Public Library reserves the right to refuse to accept a reproduction order if, in its judgment, fulfillment of that order would involve violation of copyright law.
The nature of historical archival photograph collections means that copyright or other information about restrictions may be difficult of even impossible to determine. The Olathe Public Library would like to hear from anyone who may have additional information regarding the images found in this collection. The Olathe Public Library invites copyright owners who are not properly identified to contact us so that appropriate information may be provided in the future. It is our policy to respond to notices of alleged copyright infringement in an appropriate manner, including the removal or disabling of access to material claimed to be subject of infringing activity. The Olathe Public Library is the designated agent for notice of alleged copyright infringement appearing on our Site. Direct any notices of infringement to:
